If you are already receiving Incapacity Benefit, you will continue to get it as long as you are eligible. If you have received Incapacity Benefit during the two years before 27th October 2008, you might get that again instead of Employment and Support Allowance. Jobcentre Plus will consider this when you make your claim.
Employment and Support Allowance replaces Incapacity Benefit for new claimants from 27 October 2008. You may be able to get Employment and Support Allowance if you have an illness or disability that affects your ability to work
